Terms of Use

By using Ember, you agree to these terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using Ember - Fibromyalgia Tracker ("the App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App.

The App is operated by Velora Health ("we", "us", "our"). These terms apply to all users of the App.

2. Wellness tracker - not medical advice

Ember is a wellness tracker. It is not a medical device and is not intended to diagnose, treat, cure or prevent fibromyalgia or any other condition.

The FIQR, WPI and SSS scales are self-assessments intended to be shared with your doctor, not diagnostic results. Patterns, trends and the AI Visit Brief are observations generated from your own logged data, provided to help you have a better conversation with your clinician. They do not constitute medical advice. Always consult a qualified healthcare professional about your symptoms and before changing medication or treatment, and seek urgent care for any emergency.

3. Accounts

You can log and track without an account. Generating an AI Visit Brief uses Sign in with Apple so we can verify the request and apply usage limits. You must be at least 13 years old (or the minimum age in your country) to use the brief feature.

Monthly plan: $5.99 USD per month, auto-renewing - with a 7-day free trial

Yearly plan: $39.99 USD per year, auto-renewing

Pro unlocks: full history, complete trends and correlations, the monthly AI Visit Brief and PDF export

Billing: charged to your Apple ID; manage or cancel in your Apple ID Account Settings

Payment is charged to your Apple ID at confirmation of purchase, after any free trial. Your subscription auto-renews unless cancelled at least 24 hours before the end of the current period; manage or cancel in your Apple ID Account Settings. Any unused portion of a free trial is forfeited when you purchase. The AI Visit Brief is limited to one per calendar month.

5. Acceptable use

You agree not to use the App for any unlawful purpose, to reverse engineer or attempt to extract its source code, to abuse, overload or circumvent usage limits or security, or to resell or sublicense the App.

6. Your data

You own the data you log. It is stored on your device and your private iCloud. To generate a Visit Brief, you authorise us to send a summary of your logs to our AI provider solely to produce that brief. See our Privacy Policy for full details. We do not sell your data.

7. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App, its analysis or any AI-generated report will be accurate, complete, error-free or uninterrupted.

8. Limitation of liability

To the maximum extent permitted by law, Velora Health shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of data or any health outcome, arising from your use of or inability to use the App.

9. Changes to Terms

We may modify these Terms at any time and will update the "Last updated" date. Continued use after changes constitutes acceptance of the new Terms.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which Velora Health operates, without regard to conflict of law provisions.

11. Apple's Standard EULA

In addition to these Terms, use of the App is also subject to Apple's standard Licensed Application End User License Agreement (EULA).
